ATW TRAILER WORLD CORP. d/b/a ATW STATE PRIVACY NOTICE AT COLLECTION

Certain states, including California, Colorado, Connecticut, Delaware, Iowa, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Tennessee, Texas, Utah, and Virginia require additional information regarding our privacy practices and your privacy rights. Depending on whether you are a resident of those states (“Consumer”), ATW Trailer World Corp. d/b/a ATW (collectively, “ATW,” “we,” “us,” or “our”) provides you this additional State Privacy Notice at Collection (the “State Privacy Notice”) to inform you about our privacy practices and your consumer rights relating to your personal information or personal data, as defined under those state laws (“Personal Information”).

This State Privacy Notice supplements the information contained in the ATW Privacy Policy (“Consumer Privacy Policy”). All terms not defined in the State Privacy Notice are defined in the Consumer Privacy Policy.

1. California and Other States – Notice of Information Collected and/or Disclosed

The California Consumer Privacy Act of 2018 (“CCPA”), as amended by the California Privacy Rights Act (“CPRA”) and privacy laws in Colorado, Connecticut, Delaware, Iowa, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Tennessee, Texas, Utah, and Virginia, afford Consumers residing in those states (“Consumer”) certain rights with respect to their Personal Information.

  • If you are a California Colorado, Connecticut, Delaware, Iowa, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Tennessee, Texas, Utah, and Virginia resident interacting with us in your personal or household capacity, this section applies to you.

2. Collection And Use of Personal Information

We may collect Personal Information from you in a variety of different situations, including, but not limited to on any of our websites, your mobile device, through email, in physical locations, through the mail, over the telephone, and/or in any other situation where we interact with you. More specifically, ATW collects the following categories of Personal Information from Consumers, as indicated, and we use this information to provide you Services and for other business purposes. The types of information about you that you provide and that we collect automatically are listed below along with our uses of that information:

Internet or other similar network activity: Browsing history, search history, information on a consumer’s interaction with a website, application, or advertisement, cookies (small text file stored on your hard drive or in device memory that helps us improve our websites and your experience), pixel tags and web beacons (electronic images that we use on our websites and in our emails to help deliver cookies, count visits, and understand usage), and other tracking technologies, browsing history, search history, the date, time, length of stay, and specific pages accessed during your visits to our Website), IP address, device identifiers associated with your computer or device, mobile carrier and related information, activity logs.

Geolocation data: Physical location or movements based on IP address, precise geolocation data.

·   Personalize your experience and to deliver content and product and service offerings relevant to your interests, including targeted offers and ads through third-party sites and via email (with your consent, where required by law);
·   Record information about your browsing session on the websites, including which pages you visited and any forms on the websites, and track clicks;
·   Monitor and analyze trends, usage, and activities in connection with our products and services;
·   Detect, investigate, and help prevent security incidents and other malicious, deceptive, fraudulent, or illegal activity; and
·   Carry out any other purpose described to you at the time the information was collected.
Sensory data: Audio (such as call recordings), photographs and video footage provided by Consumer or recorded as permitted by law, and photos and video recordings via Closed-Circuit Television (“CCTV”) inside and outside our stores, service and/or repair centers, including our parking lots.·   Provide and administer our Services and user accounts;
·   Help customer service representatives assist you on request;
·   Process and fulfill your transactions at our service and detect, investigate, and help prevent security incidents and other malicious, deceptive, fraudulent, or illegal activity;
·   Capture CCTV recordings and photos inside and outside our stores for security and loss prevention purposes;
·   Manage our stores, service and/or repair centers, and other facilities, including our parking lots;
·   Monitor and retain your call conversations with customer service for training purposes; and
·   Carry out any other purpose described to you at the time the information was collected.
Sensitive Personal Information: Passport or other government identification information, Social Security Number, driver’s license information, account password/login, and precise geolocation data.·   Provide and administer our Services and user accounts;·   Process and fulfill your transactions at our service and/or repair centers;
·   Respond to your requests, questions, and concerns;

Inferences drawn from other Personal Information: Profile reflecting a person’s preferences, characteristics, or behavior.·   Deliver content and product and service offerings relevant to your interests, including targeted offers and ads through third-party sites and via email (with your consent, where required by law); and
·   Carry out any other purpose described to you at the time the information was collected.

Personal Information does not include deidentified information or aggregate Consumer information that cannot reasonably be used to identify you. ATW processes, uses and discloses this information only in a deidentified manner and will not attempt to re-identify such information, except as permitted by applicable law.

ATW obtains the categories of Personal Information listed above from the following categories of sources:

  • Directly from you. For example, from forms or surveys you complete, products and services you purchase, or when you communicate with us.
  • Indirectly from you. For example, from observing your actions on our website or from information your computer or mobile device transmits when interacting with our website or mobile applications, among other things.
  • Affiliate entities. For example, our affiliate entities may give us information about you such as products and services you purchase and your use of our services.
  • Third parties. For example, the following entities may give us information about you: our business partners and vendors, when you complete forms or surveys; advertising networks and mobile advertising data providers.

3. Disclosures of Personal Information Collected and Used for a Business Purpose

In the preceding twelve (12) months, ATW has disclosed the following categories of Personal Information for the specific business purposes described below:

Sensitive Personal Information: Passport or other government identification information, Social Security Number, driver’s license information, account password/log-in, or precise geolocation data.·   Service providers, including Internet service providers, data analytics providers, operating systems and platforms, payment processors, fulfilment partners, customer support partners, marketing partners, marketing and advertising providers, fraud prevention partners, and service providers that manage our facilities, including our stores, service and/or repair centers, and parking lots.
Inferences drawn from other Personal Information: Profile reflecting a person’s preferences, characteristics, or behavior.·   Service providers such as data analytics, marketing and advertising providers.

In addition, we may disclose any of the categories of Personal Information listed above for the following purposes:

  • We may disclose Personal Information if we believe that disclosure is in accordance with, or required by, any applicable law or legal process, including lawful requests by public authorities to meet national security or law enforcement requirements.
  • We may disclose Personal Information if we believe that your actions are inconsistent with our user agreements or policies, if we believe that you have violated the law, or if we believe it is necessary to protect our rights, property, and safety, or that of our users, the public, or others.
  • We disclose Personal Information to our lawyers and other professional advisors where necessary to obtain advice or otherwise protect and manage our business interests.
  • We may disclose Personal Information in connection with, or during negotiations concerning, any merger, sale of company assets, financing, or acquisition of all or a portion of our business by another company.
  • Personal Information is disclosed between and among us and our current and future parents, affiliates, and subsidiaries and other companies under common control and ownership.·   We disclose Personal Information with your consent or at your direction.

4. California Sales and Sharing of Personal Information

California law requires that we provide transparency about Personal Information we “sell” or “share.” “Sale,” for the purposes of the CCPA, broadly means scenarios in which we have disclosed Personal Information with third parties and/or affiliates in exchange for valuable consideration, while “sharing” means we have disclosed information to a third party for cross-context behavioral advertising. In addition, the CCPA has been interpreted to deem this “sharing” to also be a form of “sale.” Accordingly, in the preceding twelve (12) months, we have “sold” or “shared” your Personal Information, including identifiers and internet or other network activity, to or with third parties for cross-context behavioral advertising, such as targeting of advertising to you based on your Personal Information obtained from your activity across businesses, websites, apps, and services other than our Services.

We do not knowingly sell, share, or use for targeted advertising the personal information about consumers under the age of sixteen (16), or a higher age in accordance with applicable law.

5. Targeted Advertising and Analytics

Similarly, privacy laws in Colorado, Connecticut, Delaware, Iowa, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Tennessee, Texas, Utah, and Virginia require that we notify you if we use your information for Targeted Advertising. Targeted Advertising means displaying advertisements to you where the advertisement is selected based on Personal Information obtained from your activities over time and across nonaffiliated websites or online applications to predict your preferences or interests. As described in the table above, we use and disclose your Personal Information for Targeted Advertising.

6. Sensitive Personal Information

Privacy laws in California, Colorado, Connecticut, Delaware, Iowa, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Tennessee, Texas, Utah, and Virginia specify certain rights with respect to our collection of certain information that such laws designate as “Sensitive Data” or “Sensitive Personal Information” (collectively, “Sensitive Personal Information”). We obtain consent to collect that information in those states where consent is required. Moreover, each state’s privacy laws may consider different pieces of information to be “Sensitive Personal Information.” When we notify residents of certain states that we collect Sensitive Personal Information, that means that we collect Sensitive Personal Information within the meaning of the law of that particular state. We collect Sensitive Personal Information in California Colorado, Connecticut, Delaware, Iowa, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Tennessee, Texas, Utah, and Virginia.  We collect the following types of Sensitive Personal Information, to the extent included in your state’s definition: Social Security Number and driver’s license. We do not use or disclose Sensitive Personal Information to infer characteristics about you.

7. Retention of Personal Information

We will not retain your Personal Information for longer than is reasonably necessary to carry out the purposes we disclose in this State Privacy Notice.

8. Your Consumer Rights and Choices

Subject to certain limitations and depending on your state of residence, you have the right to (1) request to know more about the categories and specific pieces of personal information we collect, use, disclose, and sell, and to access your information, including in a portable format, (2) request correction of your personal information, (3) request deletion of your personal information collected from or about you, which may include derived data, (4) opt out of any “sales” or “sharing” of your personal information that may be occurring or uses of your personal information for targeted advertising, (5) request a list of specific third parties to whom we disclosed your personal information or any personal information; and (7) not be discriminated against for exercising these rights.

Exercising Your Privacy Rights

To exercise the rights described above, please submit a verifiable consumer request to us by either:

Only you, or a person authorized to act on your behalf, may make a verifiable consumer request related to your Personal Information. If we need to further verify your request, we may do so by asking you to provide information related to your interactions with us. We respond to consumer rights requests from authorized agents to the extent required by applicable law. If we receive your request from an authorized agent and they do not provide a valid power of attorney, we may ask the authorized agent to provide proof that you gave the agent signed permission to submit the request to exercise rights on your behalf. In the absence of a valid power of attorney, we may also require you to verify your own identity directly with us or confirm to us that you otherwise provided the authorized agent permission to submit the request. If we deny your request, you may appeal our decision by submitting your request to [email protected] or by calling our toll-free number at 1-844-784-0309. If you have concerns about the result of an appeal, you may contact the attorney general in the state where you reside.

Opt-out Preference Signals

Some browsers allow you to enable privacy-controls in the browser’s settings to automatically signal your opt-out preference to the websites you visit (e.g., Global Privacy Control). To the extent we are required to offer opt-outs through Global Privacy Control, we honor these signals as a valid request to opt-out of the sharing of information linked to your browser. Please be aware, however, that opt-out preference tools are limited to the browser or devise you are using. Also, to maintain your privacy preferences, your browser may save some information in its cookies and cache, and if you clear cookies, you may remove your opt-out preferences so that you may have to opt-out again.

9. Changes to Our State Specific Privacy Notice

We may change this privacy notice from time to time. If we make changes to this privacy notice, we will notify you by revising the Effective Date at the top of this policy and, in some cases, we may provide you with additional notice, such as by adding a statement of notice on the website or by sending you a notification. We encourage you to review this policy regularly to stay informed about our information practices and the choices available to you.
