This Privacy Policy describes how ATW Trailer World Corp. d/b/a ATW (collectively, “ATW,” “we,” or “us”) collects, uses, and discloses information about you. This Privacy Policy applies to information we collect when you access or use our websites, and other online products and services that link to this Privacy Policy (collectively, our “Services”), or when you otherwise interact with us, such as in our stores, service and/or repair centers, through our customer support channels, or on social media pages as described herein. We may provide different or additional notices of our privacy practices with respect to certain products or services, in which case this Privacy Policy will not apply.

We may change this Privacy Policy from time to time. If we make changes, we will notify you by revising the date at the top of this policy. We may also provide you with additional notice (such as by adding a statement to the Services or sending you a notification), such as in connection with making material changes to this Privacy Policy. Collection of Information

Information You Provide to Us

We collect information you provide directly to us. For example, we collect information directly from you when you create an account, fill out a form, submit or post content through our Services, make a purchase, request customer support, request assistance with warranty registration or to process a warranty claim, schedule service and/or repair for products purchased, communicate with us via third-party platforms, participate in a contest or promotion, or otherwise communicate with us. The types of information about you that we collect include your name, email address, postal address, phone number, Social Security Number, driver’s license number, account information, and any other information you choose to provide. Additionally, if you make a purchase, we work with a third-party payment processor to collect and process your payment information.

Information We Collect Automatically

We automatically collect certain information about your interactions with us or our Services, including:

  • Transactional Information: When you make a purchase or return, we collect information about the transaction, such as product details, purchase price, and the date and location of the transaction.
  • Device and Usage Information: We collect information about how you access our Services, including data about the device and network you use, such as your hardware model, operating system version, mobile network, IP address, unique device identifiers, browser type, and app version. We also collect information about your activity on our Services, such as access times, pages viewed, links clicked, and the page you visited before navigating to our Services.
  • Information Collected by Cookies and Similar Tracking Technologies: We use tracking technologies, such as cookies, pixels, and web beacons, to collect information about your interactions with the Services. These technologies help us improve our Services, personalize your experience, see which areas and features of our Services are popular, count visits, record information about your browsing session on the websites, including which pages you visited and any forms on the websites, and track clicks.   • Audio and Video Recordings, Photos, and Calls: We also collect photos and video recordings via Closed-Circuit Television (“CCTV”) inside and outside our stores, service and/or repair centers, including our parking complexes. If you contact customer service by phone, we may monitor and retain those conversations, including for training purposes.
Information We Collect from Other Sources

We obtain information from other sources. For example, we may collect information from identity verification services, advertising networks, mobile advertising data providers, data analytics providers, mailing list providers, our business partners and vendors, third parties that you direct to disclose information to us, and affiliates of ATW. This information includes information pertaining to Services purchased or considered, payment or financial information, geolocation data (including precise geolocation data), businesses or organizations that you are associated with and where applicable, your title with that business or organization and information relating to your role, and other personal information such as comments and opinions that you provide to us in surveys, or messages you make available to us on social media.

Information We Derive

We may derive information or draw inferences about you based on the information we collect. For example, we may make inferences about your approximate location based on your IP address or infer that you are looking to purchase certain products based on your browsing behavior and past purchases.

USE OF INFORMATION

We use the information we collect in connection with our Services and to customize your experience with us. We also use the information we collect to:

  • Provide, maintain, improve, and develop new products and services, including to operate, maintain, and provide to you the features and functionality of our Services;
  • Fulfill or meet the reason you provided the information, such as to process your transaction or respond to your inquiry pertaining to matters such as warranty registration, warranty claims, servicing or repairing your purchased products;
  • Personalize your experience with us and to deliver custom content and product and service offerings relevant to your interests;
  • Send you technical notices, security alerts, support messages and other transactional or relationship messages;
  • Communicate with you about products, services, and events offered by ATW and others and provide news and information that we think will interest you (see the Your Choices section below for information about how to opt out of these communications at any time);
  • Monitor and analyze trends, usage, and activities in connection with our products and services;
  • Personalize the advertisements you see on third-party platforms and websites (for more information, see the Targeted Advertising and Analytics section below);
  • Facilitate contests, sweepstakes, and promotions and process and deliver entries and rewards;
  • Detect, investigate, and help prevent security incidents and other malicious, deceptive, fraudulent, or illegal activity and help protect the rights and property of ATW and others;
  • Capture CCTV recordings and photos inside and outside our stores for security and loss prevention purposes;
  • Manage our stores, service and/or repair centers, and other facilities, including our parking complexes;
  • Comply with our legal and financial obligations;
  • Create de-identified, anonymized or aggregated information; and
  • Carry out any other purpose described to you at the time the information was collected.

DISCLOSURE OF INFORMATION

We disclose personal information in the following circumstances or as otherwise described in this policy:

  • We disclose personal information to our vendors, service providers, contractors and consultants that access personal information to perform work for us, such as companies that assist us with web hosting, shipping and delivery, payment processing, fraud prevention, customer service, marketing and advertising, and management of our facilities, including our stores, service and/or repair centers, and parking lots.
  • If you provide a product review or otherwise provide content on our Services, we disclose this information publicly/with other users of our Services.
  • If you choose to use integrations we offer on our Services, such as disclosing your location through our Google Maps integration, we may disclose certain information to the integration partners.
  • We may disclose personal information if we believe that disclosure is in accordance with, or required by, any applicable law or legal process, including lawful requests by public authorities to meet national security or law enforcement requirements.
  • We may disclose personal information if we believe that your actions are inconsistent with our user agreements or policies, if we believe that you have violated the law, or if we believe it is necessary to protect the rights, property, and safety of ATW, our users, the public, or others.
  • We disclose personal information to our lawyers and other professional advisors where necessary to obtain advice or otherwise protect and manage our business interests.
  • We may disclose personal information in connection with, or during negotiations concerning, any merger, sale of ATW assets, financing, or acquisition of all or a portion of our business by another company.
  • Personal information is disclosed between and among ATW and our current and future parents, affiliates, and subsidiaries and other companies under common control and ownership.
  • We disclose personal information with your consent or at your direction.

We also disclose aggregated or de-identified information that cannot reasonably be used to identify you.

TARGETED ADVERTISING AND ANALYTICS

We engage others to provide analytics services, serve advertisements, and perform related services across the web and in mobile apps. These entities may use cookies, web beacons, device identifiers, and other technologies to collect information about your use of our Services and other websites and applications, including your IP address, web browser, mobile network information, pages viewed, time spent on pages or in mobile apps, links clicked, and conversion information. This information may be used by ATW and others to, among other things, analyze and track data, determine the popularity of certain content, deliver advertising and content targeted to your interests on our Services and other websites or mobile apps, and better understand your online activity. Depending on where you reside, you can opt out of cookie-based ad targeting on our website by clicking the Privacy Settings footer link. You can opt-out of mobile advertising data providers sharing your data through your device settings. On Android devices, go to the Ads link in the Privacy section under Settings and select “Delete advertising ID.”  On iOS, go to the Tracking link in the Privacy & Security section under Settings and turn off tracking for apps you choose.  You can also go to the Apple Advertising link in the Privacy & Security section under Settings and turn off “Personalized Ads.”   

Google Analytics. We use Google Analytics to recognize you and link the devices you use when you visit our Sites or services on your browser or mobile device, log in to your account on our services, or otherwise engage with us. We disclose a unique identifier, like a user ID or hashed email address, to Google to facilitate the service. Google Analytics allows us to better understand how our users interact with our service and to tailor our content to you. We may also utilize certain forms of display advertising and other advanced features through Google Analytics. These features enable us to use first-party cookies (such as the Google Analytics cookie) to inform, optimize, and display ads based on your past visits to the services. TRANSFER OF INFORMATION TO THE UNITED STATES

ATW is headquartered in the United States and we have operations and vendors in the United States and other countries. Therefore, we and those that perform work for us may transfer your personal information to, or store or access it in, jurisdictions that may not provide levels of data protection that are equivalent to those of your home jurisdiction. Where required by law, we provide adequate protection for the transfer of personal data in accordance with applicable law, such as by obtaining your consent, relying on adequacy decisions, or executing Standard Contractual Clauses.

By using our website, you may be able to link to other websites, including social media platforms, or apps (e.g., Facebook, Instagram, X, etc.) (“Third-Party Sites”). In some cases, we provide you links to third party services for your convenience. For example, we provide a link to Synchrony Bank, with whom you can apply to finance a purchase with us. We are not a lender and are not involved in the offering of credit or any decisions to offer credit. Any information you provide in connection with such financing you provide directly to Synchrony Bank and not to us. 

We do not control any Third-Party Sites and are not responsible for the contents, nature, or privacy practices of any Third-Party Sites. Any access to and use of the Third-Party Sites is not governed by this Privacy Policy, but instead is governed by the privacy policies of those Third-Party Sites. If you choose to interact with the Third-Party Sites, you should review the applicable privacy policy, as the Third-Party Sites’ privacy practices may differ from ours. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT RESPONSIBLE FOR THE PRIVACY PRACTICES OF ANY THIRD-PARTY SITES.
